… ‘Council funds intact with us’, UBA lawyer tells court

By Oluseye Ojo

The Oyo State High Court, sitting in Ibadan has scheduled Tuesday, October 14, 2025, for a ruling on applications filed by the United Bank for Africa (UBA) and other defendants in a lawsuit brought by the Attorney General of Osun State.

The applications include UBA’s request for an indefinite adjournment and another challenging the court’s jurisdiction, filed by the lawyer to the sacked APC local government chairmen, Mr Kazeem Gbadamosi (SAN).

Also, other parties, including the sacked APC chairmen and the PDP, have also filed applications seeking to join the suit.

UBA’s lawyer, Mr Mutalib Adebayo Ojo (SAN), informed the court that the local government funds in question are still safely held by the bank and have not been disbursed to any of the parties.

The presiding judge, Justice Ladiran Akintola, set the ruling date after consulting with all parties to allow sufficient time for a thorough consideration of the applications.

The court also extended its interim injunction against UBA, maintaining a restriction on 30 bank accounts holding Osun State’s local government allocations.

During the proceedings, UBA’s lawyer argued that the court should adjourn the matter sine die (indefinitely), pending the Supreme Court’s judgment on a related case. He expressed concern that the High Court’s ruling might conflict with the Supreme Court’s decision.

However, Gbadamosi opposed the application, arguing that it was an anomaly and should not be entertained until the issue of jurisdiction is resolved. He claimed that the current suit constitutes an abuse of court process, given the pending Supreme Court case.

The plaintiffs’ lawyer, Mr Musibau Adetunmbi (SAN), countered that his clients approached the court only after discovering that federal agencies – the Central Bank of Nigeria (CBN) had transferred the disputed funds to UBA despite the pending Supreme Court case.  He argued that the suit is not an abuse of process, as it arises from new facts, specifically the unlawful movement of funds to UBA between September 24 and 26, 2025.

After hearing arguments from all parties, Justice Akintola adjourned the matter for ruling on Tuesday.
